1. Agreement
These Terms are an agreement between you and Nathaniel Randle, an individual who operates the LotLifter service under the name “LotLifter” (“LotLifter”, “we”, “us”). LotLifter is not a separately incorporated company. By creating an account or using LotLifter you agree to these Terms and to the Privacy Policy. Contact: help@lotlifter.com.
2. The service
LotLifter is software for people who sell on eBay. It provides AI-assisted listing drafts, pricing suggestions from comparable listings, photo tools, publishing to your eBay account, storage locations and labels, a scanner app, and sales, shipping-label and reporting tools, through lotlifter.com and app.lotlifter.com (LotLifter Go, LotLifter Full and LotLifter Scan). LotLifter works with eBay through eBay's developer APIs. LotLifter is not affiliated with, endorsed by or sponsored by eBay Inc.
3. Eligibility and your account
- You must be at least 18 years old. LotLifter may be used by individuals, hobby and resale sellers, and businesses.
- Give accurate account information and keep your password secure. You are responsible for activity under your account, including people you allow to use a shared scanner.
- If you use LotLifter on behalf of a business, you confirm you are authorized to accept these Terms for it.
4. Your eBay account and your listings
- You connect your own eBay account and remain responsible for your listings, their accuracy, the items you sell, their condition and prices, and for following eBay's policies and applicable law.
- LotLifter publishes or changes listings on eBay only when you choose to, for example by publishing or updating a listing.
- AI output is a draft. AI-drafted titles, descriptions, item specifics, categories and prices are suggestions and can be wrong. Review them before you publish.
- Pricing suggestions are evidence, not a promise. Suggestions based on comparable listings do not assure any sale or sale price.
5. Plans, free use and billing
- Free use. Without a paid plan you can import and manage your existing eBay listings, use storage locations, labels and the scanner app, and try AI drafting on a limited number of items. Publishing new AI-created listings requires a paid plan.
- Paid plans are subscriptions billed monthly in advance through Stripe and renew automatically each month until cancelled. Each plan includes a monthly allowance of AI listings that resets each calendar month (UTC); unused allowance does not carry over. Current prices and allowances are shown at lotlifter.com/pricing and in the app.
- Changing plans. When you move to a higher plan, the prorated difference for the rest of the current period is charged at the time of the change. When you move to a lower plan, the unused value of the current period is applied as a credit toward your next invoice.
- Cancellation. You can cancel at any time in LotLifter (Account → Manage billing). Cancelling stops the next renewal; your plan continues until the end of the billing period you have already paid for.
- Refunds. Subscription fees are generally non-refundable, and we do not provide prorated refunds for cancellation or unused allowance. Nothing in these Terms limits any refund or other right you have under applicable law.
- Price changes. For a material price increase affecting your existing paid subscription, we will email you at least 30 days in advance, and the new price will apply no earlier than your first renewal after that notice period.
- Taxes. Prices do not include taxes unless stated; applicable taxes may be added.
6. Shipping labels
Shipping labels are bought on your own ShipEngine account. Postage charges are between you and your shipping provider; LotLifter does not pay postage for you or mark it up.
7. Acceptable use
Do not use LotLifter to list or sell prohibited or unlawful items, infringe anyone's rights, mislead buyers, interfere with or overload the service, attempt to access other users' data or accounts, probe or bypass security, or resell or redistribute the service without our permission.
8. Your content
You keep ownership of your photos, listing content and other data. You give LotLifter permission to store and process them to provide the service to you, including sending item photos and details to the service providers described in the Privacy Policy (for example, for AI drafting and comparable-listing search). LotLifter may use aggregated or de-identified statistics to understand and improve the product. LotLifter does not use your photos, listing content or other customer content to train AI models, and does not sell your content.
9. Suspension and termination
- You may stop using LotLifter at any time. Your eBay listings remain on eBay.
- We may suspend or terminate access for violation of these Terms, non-payment, fraud or abuse, security threats, conduct that threatens other users, activity that creates material risk to eBay accounts, connected services, LotLifter's infrastructure or other users, or unlawful use. We will give notice where reasonably practical; we may suspend without advance notice when necessary to protect users, connected accounts or the service.
- After an account is closed, personal data is deleted or de-identified as described in the Privacy Policy, subject to the records we must or reasonably need to keep.
10. Availability and third-party services
We work to keep LotLifter available and accurate, but the service is provided “as is” and “as available”. We do not promise that it will be uninterrupted or error-free, that any listing will sell or perform in any particular way, or that eBay, AI, shipping, payment or other third-party services and APIs LotLifter relies on will remain available or unchanged. Features that depend on those services can change or stop when the providers change them. We may change, add or remove features over time.
11. Disclaimers
To the extent permitted by applicable law, LotLifter disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the extent permitted by applicable law: (a) LotLifter will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, sales, data or goodwill, arising from or related to LotLifter or these Terms; and (b) LotLifter's total liability for all claims arising from or related to LotLifter or these Terms is limited to the amount you paid LotLifter in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from or related to these Terms or LotLifter will be brought in the state or federal courts located in the State of Texas, and you and LotLifter consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.
14. Changes to these Terms
For material changes, we will email account holders and, where practical, show a notice in the app, normally at least 30 days before the change takes effect. Minor corrections, clarifications and changes that do not materially reduce your rights may take effect when posted. Continuing to use LotLifter after a change takes effect means you accept the updated Terms.
15. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a transfer of the LotLifter service. These Terms and the Privacy Policy are the entire agreement about LotLifter between you and us.
